Terms of service

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  1. Entrepreneur: the natural or legal person who offers products to consumers at a distance.

  2. Consumer: the natural person who does not act in the exercise of a profession or business.

  3. Agreement: the purchase agreement concluded between the Entrepreneur and the Consumer.

  4. Product: all physical clothing items offered via the webshop.

Article 2 – Identity of the Entrepreneur

Article 3 – Applicability

  1. These Terms and Conditions apply to every offer made by the Entrepreneur and to every distance Agreement concluded between the Entrepreneur and the Consumer.

  2. Deviations from these Terms and Conditions are only valid if explicitly agreed upon in writing.

  3. Any general terms and conditions of the Consumer are expressly rejected.

Article 4 – The Offer

  1. The offer contains a complete and accurate description of the Products offered.

  2. Obvious mistakes or errors in the offer do not bind the Entrepreneur.

  3. Images are a truthful representation of the Products; however, minor color deviations may occur.

Article 5 – The Agreement

  1. The Agreement is concluded at the moment the Consumer accepts the offer and complies with the stated conditions.

  2. The Entrepreneur confirms the Agreement electronically.

Article 6 – Right of Withdrawal

  1. The Consumer has the right to withdraw from the Agreement within 30 days after receipt of the Product, without stating reasons.

  2. During the withdrawal period, the Consumer must handle the Product and its packaging with care.

Article 7 – Costs in Case of Withdrawal

  1. The costs of returning the Product are borne by the Consumer.

  2. The Entrepreneur shall refund all payments received, excluding any additional costs resulting from a more expensive shipping method chosen by the Consumer, within 30 days after withdrawal.

  3. Refunds shall be made using the same payment method as used for the original transaction.

Article 8 – Limitation of the Right of Withdrawal

  1. During the withdrawal period, the Consumer must handle the Product and packaging with care.

  2. The Consumer may only handle and inspect the Product as would be permitted in a physical retail store.

  3. If the Product has been used beyond what is necessary to determine its nature, characteristics, and functioning, the Consumer is liable for any resulting depreciation in value.

  4. The Entrepreneur reserves the right to deduct such depreciation from the refund.

  5. Products that show visible signs of wear, usage, or are no longer hygienically resalable may result in a reduced refund.

Article 9 – Prices

  1. All prices include VAT.

  2. Shipping costs are clearly stated prior to the conclusion of the Agreement.

  3. Price changes after the Agreement has been concluded do not affect existing Agreements.

Article 10 – Conformity & Warranty

  1. The Entrepreneur guarantees that the Products comply with the Agreement and meet reasonable expectations.

  2. Any defects must be reported within a reasonable period after discovery.

  3. Statutory consumer rights remain fully applicable.

Article 11 – Delivery & Execution

  1. Delivery takes place at the address provided by the Consumer.

  2. The Entrepreneur aims to deliver within the stated delivery period.

  3. The risk of damage or loss remains with the Entrepreneur until the moment of delivery to the Consumer.

Article 12 – Payment

  1. Payment must be made using the payment methods offered in the webshop.

  2. The Entrepreneur reserves the right to refuse orders in the event of payment issues.

Article 13 – Liability

  1. The Entrepreneur is only liable for direct damages.

  2. Liability is limited to the amount of the relevant order, unless there is intent or gross negligence.

  3. This limitation does not apply where statutory liability cannot be excluded.

Article 14 – Complaints Procedure

  1. Complaints must be submitted via email within 14 days after discovery.

  2. The Entrepreneur will respond to complaints within 14 days of receipt.

Article 15 – Governing Law & Disputes

  1. These Terms and Conditions are governed by Dutch law.

  2. Any disputes shall be submitted to the competent court in the Netherlands.
